The Provincial High Court of Madrid fully considers the appeal filed by the legal team of Afianza in defense of the rights of the insured, achieving a sentence that exceeds 800,000 euros to a large insurer.
Favorable ruling in the Provincial High Court of Madrid consolidates the leadership of Afianza
Madrid, May 23, 2025.– Afianza, a firm specializing in legal services and comprehensive consulting for companies, has strengthened its position as a reference office in complex disputes related to the insurance sector after obtaining a favorable judgment in a case related to material damage arising from the storm Filomena. This judicial decision, issued by the 18th Section of the Provincial Court of Madrid, represents a significant milestone in the defense of the rights of the insured against large insurance entities.
With extensive experience in the resolution of high-specialization legal issues, the legal team of Afianza managed to have the court fully consider the appeal filed, thus revoking the decision of the Court of First Instance No. 104 of Madrid. The insurer, who was initially exempted from liability, is now sentenced to compensate the insured company with more than 800,000 euros, including material damage, loss of rents, expert fees and interest under article 20 of the Insurance Contract Law.

Judgment No. 36/2025 states that the collapse of the industrial ship was due to the weight of the snow accumulated on the skylight, a risk expressly covered by the policy. The court rejected the insurer’s arguments, which attempted to impute the damage to an alleged unaccredited design defect, and dismissed the expert reports it presented, for referring to a ship other than the sinister and without sufficient evidentiary value.
